The editorial states: “Interim Palm Beach County State Attorney Peter Antonacci has lost a fight he never should have started. On Tuesday [July 10], the 4th District Court of Appeal rejected Mr. Antonacci’s attempt to remove Judge Barry Cohen from a murder trial that starts in August. . . . Mr. Antonacci’s overall argument was that because Judge Cohen has made unfavorable comments from the bench about parts of Florida’s criminal justice system, he has displayed ‘personal bias’ and ‘prejudice,’ and the prosecution would not get a fair hearing. Under Florida’s restrictive judicial code, Judge Cohen could say nothing in his defense. Fortunately, many lawyers did. They pointed out that while Judge Cohen has criticized, say, minimum-mandatory sentences, he never has failed to follow the law — even when he disagrees with it.” (Read Full Article Here)
