Disney Cruise Injury Lawyers in Melbourne, FL
Why Call Douglas R. Beam P.A. After a Disney Cruise Injury
As of 2026, booking a Disney cruise binds you to Disney’s cruise contract, whether or not you ever sign a copy. That contract decides which court can hear your injury case. Disney’s U.S. contract says every claim must be brought in “ANY COURT OF COMPETENT JURISDICTION LOCATED IN BREVARD COUNTY, FLORIDA, U.S.A., OR THE UNITED STATES DISTRICT COURT, MIDDLE DISTRICT OF FLORIDA, ORLANDO DIVISION,” and nowhere else. That holds even if you live in another state, and whichever Disney ship or port you sailed from.
Port Canaveral, home port for the Disney Wish, Treasure and Fantasy (and in 2027 the Dream and Destiny), is in Brevard County. So is our office in downtown Melbourne. Of the seven cruise lines that call Port Canaveral home, Disney is the only one whose contract sends injury cases to Brevard County or Orlando. Under their U.S. contracts, the other six send them to South Florida. Since 1988, our firm has recovered over $1 billion for Florida clients, and with us you work directly with our trial lawyers, not a call center. When Disney’s contract brings your case to Brevard County, it’s coming to our home.

Big Results. Little Stress.
Disney’s contract gives you far less time than most injury cases. Counting from the day of the accident, Disney’s U.S. cruise contract gives you:
- 6 months to deliver written notice of your claim, “WITH FULL PARTICULARS,” to Disney’s office
- 1 year to file your lawsuit
- 120 days after filing to serve Disney with it (federal court rules generally allow only 90)
The notice goes to the office address printed in the contract, as of October 2026: 210 Celebration Place, Celebration, FL 34747. A guest services complaint, an onboard incident report, a phone call or an insurance claim may not count as that notice. Federal maritime law would otherwise give you 3 years to sue, and Florida’s own injury deadline is 2. Federal law does let a cruise line cut those windows, but no shorter than 6 months for notice and 1 year to file. Disney’s contract cuts them to exactly that. The contract says only a director of Disney’s cruise company can waive these deadlines, and only in writing.
Federal maritime law generally governs injuries on board a cruise ship, even in a Florida court. A cruise line owes its passengers reasonable care under the circumstances. In an everyday slip or trip case, the case usually turns on whether the cruise line knew, or should have known, about the hazard. And if Disney says you were partly to blame, federal maritime law generally reduces your recovery by your share instead of wiping it out the way Florida’s 51% rule can in an ordinary injury case.
Disney cruise injury claims can include falls on wet pool decks, stairs and gangways, pool and water slide injuries, children hurt in kids clubs or pools, falling objects and heavy doors, tender accidents, assaults, overboard incidents and deaths at sea. FAQs About Cases Handled by Our Disney Cruise Injury Lawyers in Melbourne, FL
A Disney cruise injury doesn’t work like a car crash or a fall at a store. The contract you agreed to when you booked sets the deadlines and the courts, and federal maritime law sets the rules. Here are the questions people ask most, answered from Disney’s own contract and the law as written. Hurt at a Disney park instead? See our Disney World injury page. Or schedule your free consultation today.
Yes. Disney’s contract lists many things Disney says it isn’t responsible for, but it keeps one big exception: “THE NEGLIGENCE OF THE CARRIER OR ITS EMPLOYEES ACTING WITHIN THE COURSE AND SCOPE OF EMPLOYMENT.” Under federal maritime law, a cruise line owes its passengers reasonable care under the circumstances. When Disney or its crew falls short and you’re hurt, you can bring a claim.
The catches: each guest brings their own case, not a class action. It must be filed in Brevard County or the federal court in Orlando. And the deadlines are short, so talk to a lawyer early.
Get medical care first. Then tell a crew member what happened and ask for an incident report. Note who took the report and when, and ask for a copy. Before you leave the ship, ask the medical center for your records and an itemized bill. Take photos of what caused the injury, like a wet deck or a broken step, and get the names and cabin numbers of anyone who saw it.
Ask Disney in writing, right away, to save any video. Ships only have to keep security video for 20 days. Disney’s U.S. contract doesn’t require an onboard report, but make one anyway: it helps show the ship knew about your injury. Then call us well before the 6-month mark.
Disney’s U.S. contract says your case goes to a court in Brevard County, Florida, or to the federal court in Orlando, “TO THE EXCLUSION OF COURTS LOCATED IN ANY OTHER COUNTY, DISTRICT, STATE, COUNTRY, TERRITORY OR POSSESSION.” The U.S. Supreme Court has enforced this kind of clause in a cruise contract, so plan on it holding, whatever state you live in.
Our office sits right in Brevard County. Much of the work happens by phone and email, so you don’t have to move your life to Florida to bring your case here. One exception: Disney has separate contracts for guests from some other countries. The one for U.K. residents sends claims to London and requires reporting the accident on board.
Counting from the day of the accident, even if symptoms showed up later, you have 6 months to deliver written notice to Disney’s office and 1 year to file suit. Then Disney has to be served quickly: the contract says within 120 days, and federal court rules generally allow only 90.
If you already missed the 6-month notice, call us anyway. Federal law says a missed notice “is not a bar to recovery” if a court finds the ship’s owner, master or agent knew about the injury and the owner wasn’t harmed by the delay, if there was a satisfactory reason the notice couldn’t be given, or if the owner doesn’t object. That doesn’t extend the 1-year deadline to file suit.
More Questions About Disney Cruise Injury Claims
Some Disney cruise injuries follow their own rules. Here are short answers on shared fault, children, deaths, assaults, injuries ashore, bills and more.
Being partly at fault doesn’t automatically end your case. For an injury on board, federal maritime law generally applies, even in a Florida state court, and the U.S. Supreme Court has said an injured person’s own carelessness on a ship counts “only in mitigation of damages.” It reduces what you recover by your share, instead of Florida’s usual rule that more than 50% at fault means no recovery. Judges decide how the law applies to the facts of each case.
Mostly the same. Disney’s contract defines a “Guest” as every passenger, “adult, minor or incompetent person,” so the 6-month and 1-year deadlines are written for children too. Federal law pauses the notice deadline for a minor until a legal representative is appointed or 3 years pass, whichever comes first. It doesn’t say the 1-year deadline to sue is paused, so call us early. Write down which youth area or pool it was, the time, and the names of any counselors or crew involved.
We’re so sorry. When a death is caused by a wrongful act, neglect or default more than 3 nautical miles from the U.S. shore, a federal law, the Death on the High Seas Act, lets the personal representative bring a case for the spouse, parents, children or dependent relatives, for “fair compensation for the pecuniary loss,” meaning the family’s financial losses. Deaths in port or close to shore follow different rules, and judges decide which apply.
Federal law pauses the notice deadline until a representative of the estate is appointed or 3 years pass, whichever comes first. It doesn’t say the 1-year deadline to sue is paused, so have a representative appointed quickly. Our wrongful death lawyers can walk your family through it with care.
Get to safety and get medical care. Federal law requires large cruise ships sailing from U.S. ports to carry sexual assault exam equipment, have trained medical staff on board at all times, keep your exam information confidential, and give you a private line to reach law enforcement or a lawyer.
The federal appeals court that covers Florida has held that a cruise line is responsible for a crew member’s assault on a passenger during the cruise, even without proof the cruise line was careless. If another passenger was the attacker, the case turns on what the cruise line knew about the risk. Ask in writing for a copy of any video. Ships only have to keep security video for 20 days unless the incident is reported to law enforcement, so act quickly. Our sexual abuse attorneys handle these cases with care and privacy.
Injuries ashore work differently. Disney’s contract says excursion and tour companies “ARE INDEPENDENT CONTRACTORS AND ARE NOT ACTING AS AGENTS OR REPRESENTATIVES OF THE CARRIER,” and that Disney isn’t liable for what happens ashore, except for negligence during water transportation Disney provides. The contract says you can get the excursion company’s name “UPON REQUEST FROM THE SHORE EXCURSION MANAGER,” so ask before you leave the ship.
A cruise line still has to warn passengers about dangers it knows of in places it invites them to visit. The contract doesn’t name Disney’s island destinations, so judges decide how these rules apply to an island injury, based on the facts.
Keep every bill. Ask the ship’s medical center for an itemized bill and your records before you leave the ship, and keep receipts for care after you get home. If you bought travel insurance, file with it too. When Disney’s negligence caused your injury, your medical costs can be part of your claim against Disney.
No. The notice is a written claim, with full details, delivered to Disney’s office at the address in your cruise contract. A guest services complaint, a phone call or an insurance claim may not count. Send it in a way you can prove it arrived, and keep a copy. The lawsuit is a separate step with its own 1-year deadline.
Not on where you file. Seven cruise lines call Port Canaveral home, and Disney’s is the only contract that sends injury cases to Brevard County or Orlando. Under their U.S. contracts, the other six name courts in South Florida. Their deadlines are short too, so if you sailed with another line, check your own contract.
Yes. It says Disney isn’t liable for emotional distress unless it came from a physical injury, or an actual risk of one, caused by the negligence or fault of a crew member or the ship’s manager, agent, master, owner or operator, or was inflicted on purpose by one of them. Federal law says a clause like this can’t limit a cruise line’s liability in a case involving sexual harassment, sexual assault or rape.
